Your membership dues are billed in November of every calendar year and due by January first of each calendar year. If Your dues are not paid by January 31 of each calendar year, your membership is cancelled. To reinstate you membership there is a $50.00 re-enrollment fee.

The Missoula Construction Council has the right to cancel a membership at any time.

ONLINE PLAN SERVICE - TERMS OF USE

This is an agreement between "you" and the Missoula Plans Exchange ("MPE"). This agreement explains the basis upon which the transactions between you the MPE will take place and our responsibilities toward each other.

The term "you" shall refer to yourself. By entering into this agreement, in addition to transactions entered into by you on your behalf, you also agree to be bound by the terms of this agreement for transaction entered into on your behalf by anyone who uses the account you've established at the Missoula Plans Exchange, whether or not the transactions were in your behalf.

Restriction of Services; Right of Refusal

You agree not to use the services provided by the Missoula Plans Exchange, or to allow or enable others, to use the services provided by the Missoula Plans Exchange for the purpose of:

  • - repetitive, high volume inquiries into any of the services provided by MPE
  • - infringement of copyright laws
You agree that the Missoula Plans Exchange, in its sole discretion and without liability to you, may suspend your online privileges, in the event you share your user name and password with individuals outside your company, for a period of not less than, but not limited to a period of three months, with no refund of fees being issued.

Limitation of Liability

All participants of the online bulletin hereby agree and attest that no officer, member, employee or agent of the Missoula Construction Council, Inc. or Missoula Plans Exchange shall be personally liable for any direct, indirect, incidental, or consequential damages whatsoever resulting from the use or inability to use any of the Missoula Plans Exchanges services or for the cost of obtaining substitute services except for events of gross negligence or the misappropriation of funds.

The Missoula Plans Exchange Disclaims any loss or liability from:

  • - access delays or interruptions to our website
  • - data non-delivery or misdelivery between you and the MPE
  • - events beyond our control (i.e. acts of God, or of third parties)
  • - errors, omissions, misstatements, or misinterpretations
  • - development or interruption of your Internet connection or access
  • - errors taking place with regard to the processing of your application for service
  • - any act or omission caused by you or your agent

Disclaimer of Warranties

We make no warranty that our service(s) will meet your requirements. Although we will make all possible efforts to maintain our system and its connection, we can not guarantee that the service(s) will be uninterrupted, timely, secure or error free, or that defects will be corrected. We do not warranty, nor make any representations regarding the use, or results of, any of the services we provide, in terms of their correctness, accuracy, reliability or otherwise.

Severability

You agree that the terms of this agreement are sever able. If any part of this agreement is determined to be unenforceable or invalid, that part of the agreement will be interpreted in accordance with applicable law as closely as possible, in line with the original intention of both parties of the agreement. The remaining terms and conditions of the agreement will remain in full force and effect.

Modifications

You agree that these terms of use may be amended from time to time by the Missoula Plans Exchange. MPE may also discontinue services it provides under this agreement. You agree to be bound by any changes MPE may reasonably make to this agreement when such changes become effective. Should you elect to cancel your agreement with the Missoula Plans Exchange at any given time, you will receive a prorated refund of any fees you may have paid to MPE.
